Well, for starters, Hamilton died in 1804. The War of 1812 occurred a bit later than that. So he was unable to serve in it. As for the duel, it started when a friend of Burr's recounted to him the things Hamilton had said about him at a dinner party. Since Hamilton saw Burr as a vile threat to the country, he could not and would not retract them. Burr was left no other option to defend his honor.
